Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you and 3442 Labs governing your use of the Services. If you do not agree, do not use the Services. Where a separate written agreement (such as an order form or master subscription agreement) exists between your organization and 3442 Labs, that agreement controls in the event of a conflict.

• “Services” — the console, websites, APIs and related offerings.
• “Customer Data” — data your organization submits to or generates within its tenant.
• “Agent” — an automated operator (APEX Intelligence) that acts within your tenant under granted permissions.
• “Tenant” — your organization’s isolated workspace within .

You must provide accurate information and keep it current. You are responsible for safeguarding your credentials and for all activity under your account. You must be authorized to act on behalf of the organization you represent and be of legal age to enter into a contract. We may suspend accounts that violate these Terms.

The Services are currently offered as an early-access release. They are provided on an “as-available” basis and may change, break, or be discontinued without notice. Features, limits and pricing may evolve. We may impose usage limits or invite access by operator type. Feedback you provide may be used to improve the Services without obligation to you.

You agree not to:

• use the Services unlawfully or in violation of applicable aviation, export or trade-control regulations;
• misrepresent the airworthiness, traceability, or certification status of any part or record;
• attempt to access another tenant’s data, probe or breach security, or disrupt the Services;
• reverse engineer, resell or misuse the Services except as permitted by law;
• upload malicious code or infringing, unlawful content.

As between you and 3442 Labs, your organization owns its Customer Data. You grant us a limited license to host, process and transmit Customer Data solely to provide and support the Services. We protect Customer Data under our security and zero-knowledge model and handle it per our Privacy Policy. We do not use Customer Data to train shared or third-party AI models.

• agents act only within the permissions your organization grants them;
• agents prepare and propose work and hold consequential actions for human approval;
• you are responsible for reviewing and approving outputs before relying on them, including any quote, purchase order, disposition, or release;
• automated outputs may contain errors and should be verified consistent with your procedures.

Paid plans are governed by the pricing presented to your organization or set out in an order form. Unless stated otherwise, fees are exclusive of taxes. During early access, some features may be provided at no charge; we may introduce or change fees on reasonable notice.

The Services, including all software, design, and the and 3442 Labs marks, are owned by 3442 Labs or its licensors and are protected by law. Except for the rights expressly granted to use the Services, no rights are transferred to you. You may not use our marks without prior written permission.

The Services are provided “as is” and “as available” without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that outputs will be accurate or complete.

To the maximum extent permitted by law, 3442 Labs will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenues, data or goodwill. Our aggregate liability arising out of or relating to the Services will not exceed the amounts paid by your organization to us for the Services in the twelve months preceding the claim, or, during a no-fee early-access period, US $100.

These Terms apply while you use the Services. You may stop using the Services at any time. We may suspend or terminate access for breach, legal risk, or discontinuation of the Services. On termination, your right to use the Services ends; we will make Customer Data available for export for a reasonable period, after which it may be deleted in line with our retention practices.

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, and the parties submit to the exclusive jurisdiction of the courts located there, except where applicable law provides otherwise. If any provision is held unenforceable, the remaining provisions remain in effect.
